4. How Do We Disclose Personal Data?

Under certain circumstances, we may disclose your personal data to third parties for legitimate purposes in accordance with this Privacy Policy. Such circumstances may include the following:

  • To Shopify, as well as vendors and other third parties who perform services on our behalf (e.g., IT management, payment processing, data analysis, customer support, cloud storage, fulfillment, and shipping).

  • We disclose personal data to business and marketing partners who provide marketing services to you and display advertisements to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activities across different merchants and websites. Our business and marketing partners use your data in accordance with their own privacy policies. Depending on where you live, you may have the right to direct us not to share information about you to display targeted advertising and marketing based on your online activities across different merchants and websites. If you wish to exercise your right and opt-out of such uses, you have the opportunity to do so here.

  • When you request us or otherwise give your consent to disclose certain information to third parties, for example, to deliver products to you, or when you use social media widgets or login integrations.

  • We disclose personal data to our affiliates or otherwise within our corporate group.

  • In connection with a business transaction such as a merger or bankruptcy, to comply with applicable legal obligations (including responding to subpoenas, search warrants, and similar requests), to enforce applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

5. Relationship with Shopify

The Services are hosted by Shopify, whereby Shopify collects and processes personal data about your access to and use of the Services in order to provide and improve the Services to you. Data you submit to the Services is shared with Shopify as well as third parties, who may be located in countries other than your country of residence, to provide and improve the Services for you. To protect, expand, and improve our business, we also use certain enhanced Shopify features that incorporate data and information from your interactions with our shop, with other merchants, and with Shopify. To provide these enhanced features, Shopify may use personal data collected about your interactions with our shop, other merchants, and Shopify. Under these circumstances, Shopify is responsible for processing your personal data, including responding to your requests to exercise your rights regarding the use of your personal data for these purposes. For more information on how Shopify uses your personal data and what rights you have, please see the Shopify Consumer Privacy Policy. Depending on where you live, you can exercise certain rights regarding your personal data listed here: Link to the Shopify Privacy Portal.

6. Supplementary Transparency Notice under the EU Data Act for Connected Products and Related Services

(Note: This section supplements our privacy policy specifically for the use of connected hardware products such as GMKtec Mini PCs in accordance with Regulation (EU) 2023/2854.)

I. General Information This section applies to connected products from GMKtec and related optional services, online functions, download or update services, and support services, provided they are offered or used in the European Economic Area (EEA). GMKtec Mini PCs are primarily computing devices intended for local processing. Certain online functions, download or update services, and support services can be voluntarily activated or used by users. If these functions are not activated and used, corresponding service or connection data is generally not transmitted to GMKtec for this reason.

II. What Data May Be Generated During Use? During normal use of a GMKtec device, technical data necessary or useful for the operation of the device, execution of the software, connection to optional services, or processing of support requests may be generated. Depending on the model, operating system, software version, device configuration, and activated functions, this data may include, in particular:

  • Device status data, system and error logs.

  • Software version data.

  • Connection or network status information.

  • Information regarding downloads or updates.

  • Technical diagnostic data provided by users in the context of a support request.

When users use optional online functions or download/update services, technical connection data, download status, version information, or operational data necessary for the provision of the respective service may be processed.

Important Note: GMKtec does not automatically collect personal content, files, documents, images, videos, local inputs, or business data processed locally that users store or use on their device, unless expressly requested by the user, for example, in the context of a support request.

III. Data Storage and Use Much of the data generated during the use of a GMKtec Mini PC is processed locally on the device. Transmission to GMKtec occurs, in principle, only when users activate a related optional service, use an online function, download content or updates, request an update, or contact GMKtec support.

When data is transmitted to GMKtec, processing is limited, in principle, to what is necessary for the corresponding purpose. These purposes may include, in particular: providing optional online, download, or update functions, offering software updates or functions, managing support requests, analyzing technical errors, improving stability, compatibility, and user experience, as well as complying with legal or contractual obligations. GMKtec will endeavor, as far as possible, to limit, aggregate, or process technical analysis or diagnostic data in such a way that direct identification of specific individuals is not the primary objective.

IV. Data Access and Rights under the EU Data Act In accordance with applicable regulations, users may request access to the relevant data generated by the use of a connected product from GMKtec or a related optional service, provided such data is accessible to GMKtec. Where technically feasible and legally applicable, users may also request the provision, transmission, or erasure of such data. The scope of such a request may depend on the data actually generated, whether GMKtec can access it, the existence of legal retention obligations, and the rights or legitimate interests of third parties.

V. Access to Data by Third Parties Third parties authorized by users may also request access to relevant data in accordance with the EU Data Act, provided applicable legal requirements are met and the data in question is accessible to GMKtec. An authorization or consent granted may, in principle, be withdrawn at any time with future effect. Such withdrawal shall not affect the lawfulness of processing carried out before the withdrawal.

VI. Termination of Optional Services Users can, in principle, stop using or deactivate related optional services. The deactivation of certain online, download, update, or support functions may make some functions, downloads, updates, synchronization functions, or diagnostic capabilities completely or partially unavailable. When a user account, online function, or related service is deleted or deactivated, certain data may still be retained for a limited period in accordance with applicable legal obligations or technical requirements. Restoration of deleted data or services may not be possible in all cases.

7. Third-Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to websites that are not affiliate websites or are not controlled by us, you should review their privacy and security policies as well as other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such websites, including the accuracy, completeness, or reliability of the information contained on them. Information you provide in public or semi-public places, including information you share on third-party social networking platforms, may also be viewed by other users of the Services and/or users of those third-party platforms, without restriction as to its use by us or by a third party. Our inclusion of such links does not imply that we endorse the content of those platforms or their owners or operators, unless expressly stated in the Services.

8. Children's Data

The Services are not intended for use by children, and we do not knowingly collect personal data from children who are not of legal age in your country. If you are the parent or guardian of a child who has provided us with their personal data, you can contact us using the contact details provided below to request the erasure of that data. At the time this Privacy Policy takes effect, we have no knowledge of "sharing" or "selling" personal data of individuals under 16 years of age (as those terms are defined by applicable law).

9. Security and Retention of Your Data

Please note that no security measures are perfect or impenetrable, and we therefore cannot guarantee "perfect security." In addition, information you send us may be exposed to risks during transmission. We recommend that you do not use insecure channels when transmitting sensitive or confidential information to us.

How long we retain your personal data depends on various factors. These include, for example, whether we need the data to manage your account, provide services to you, comply with legal obligations, resolve disputes, or enforce other applicable contracts and policies.

10. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal data. However, these rights are not absolute, may apply only under certain circumstances, and in certain cases, we may refuse your request within the limits permitted by law.

  • Right of Access/Information: You may have the right to request access to the personal data we hold about you (including relevant product data under the EU Data Act, if accessible).

  • Right to Erasure: You may have the right to request that we delete the personal data we hold about you.

  • Right to Rectification: You may have the right to request that we correct inaccurate personal data we hold about you.

  • Right to Data Portability: You may have the right to receive a copy of the personal data we hold about you and request that we transfer it to a third party under certain circumstances and with certain exceptions.

  • Right to Opt-Out of the Sale or Sharing of Data for Targeted Advertising: Depending on where you live, you may have the right to opt-out of the "sale" or "sharing" of your personal data or object to the processing of your personal data for purposes that are considered "targeted advertising" under applicable data protection laws. If you wish to exercise your right and object to such uses (opt-out), you have the opportunity to do so here.

Please note: If you visit our website with the "Global Privacy Control" opt-out signal enabled, we will automatically treat this, depending on your location, as an opt-out request for the device and browser with which you visit the website. If we can link the device emitting the signal to a Shopify account, we will also apply the opt-out request to that account. For more information on Global Privacy Control, visit https://globalprivacycontrol.org/. Apart from Global Privacy Control, we do not recognize any other "Do Not Track" signals that may be sent by your web browser or device.

Management of Communication Settings: We may send you promotional emails. You can opt-out of receiving these emails at any time by using the unsubscribe option contained in our emails to you. If you opt-out, we may still send you non-promotional emails, such as about your account or orders you have made.

If your residence is in the United Kingdom or the European Economic Area: Subject to exceptions and limitations by local law, you may exercise the following rights in addition to the rights mentioned above:

  • Right to Object and Right to Restrict Processing: You may have the right to request that we stop or restrict the processing of personal data for certain purposes.

  • Withdrawal of Consent: Insofar as we rely on consent to process your personal data, you have the right to withdraw this consent. If you withdraw your consent, this does not affect the lawfulness of the processing based on your consent prior to the withdrawal.

You can exercise these rights if indicated accordingly in the Services, or by contacting us using the contact details provided below. For more information on how Shopify uses your personal data and what rights you have, including rights in relation to data processed by Shopify, please see https://privacy.shopify.com/en.

You will not suffer any disadvantages by exercising these rights. Insofar as permitted or required under applicable law, we may need to verify your identity before we can process your requests. To process your request regarding product data (EU Data Act), information such as product model, serial number, or order number may need to be provided. In accordance with applicable laws, you may designate an authorized agent to make requests to exercise your rights on your behalf. Before we accept such a request from an agent, we require proof from them that you have authorized them to act on your behalf. This may require you to confirm your identity directly to us. We will respond to your request promptly within the framework of applicable law.

11. Complaints

If you have complaints about how we process your personal data, please contact us using the contact details provided below. Depending on where you live, you have the right to appeal our decision by contacting us at the contact details below or lodge your complaint with the competent data protection authority. For the European Economic Area, there is a list of competent data protection supervisory authorities. If you wish to retrieve it, you have the opportunity to do so here.

12. International Transfers

Note that we may transfer, store, and process your personal data outside the country in which you reside. If we transfer your personal data outside the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses or equivalent contracts issued by the respective competent authority of the United Kingdom, unless the data transfer takes place to a country that has been demonstrated to provide an adequate level of protection.

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time, for example, to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, adjust the "Last Updated" date accordingly, and make the notice required by applicable law.
